1. Service

Lagoon provides a programmatic API for searching and retrieving structured metadata about art posts, artists, and tags across multiple platforms. The API returns structured metadata and scaled thumbnail images for identification purposes. Lagoon does not host or distribute full-resolution artwork.

2. Access and API Keys

The API is available at a limited rate without an API key. Paid API keys provide higher rate limits and are issued upon payment for the subscription period. Keys are personal to the purchaser and may not be shared, resold, or transferred. We reserve the right to revoke any key or restrict any IP address at our sole discretion.

3. Acceptable Use

You may use the API for lawful purposes including research, application development, portfolio management, artist discovery, and content moderation tooling. You may not use the API to:

  • Systematically scrape or redistribute the full dataset
  • Build a competing metadata aggregation service using our data
  • Harass, stalk, or target any artist or individual identified in the data
  • Search for, attempt to access, or solicit any prohibited content as described in Section 4
  • Circumvent rate limits, content filters, or other technical restrictions
  • Violate any applicable federal, state, or local law

4. Prohibited Content

Lagoon maintains automated content filters that exclude certain categories of content from the database at the point of ingestion. Content depicting, describing, or tagged with the following is not indexed and is not available through the API:

  • Child sexual abuse material (CSAM) or sexualized depictions of minors, including but not limited to illustrated, computer-generated, or fictional depictions
  • Content tagged with terms associated with the sexualization of minors
  • Gore, torture, mutilation, or graphic depictions of death
  • Bestiality
  • Content promoting hatred or violence based on race, ethnicity, or religion

This filtering is performed by automated systems and is not guaranteed to be exhaustive. If you encounter metadata that you believe describes prohibited content, report it to [email protected] and we will investigate and remove it promptly.

5. Policy on Child Sexual Abuse Material

Lagoon has a zero-tolerance policy toward child sexual abuse material in any form. This includes real, illustrated, computer-generated, and fictional depictions of minors in sexual situations. This policy applies to all metadata in our database, including tags, descriptions, and titles.

Attempting to use the API to search for, locate, or identify such material is an immediate and permanent violation of these terms. Upon detection of such activity, we will:

  • Immediately and permanently terminate access with no refund
  • Preserve all relevant logs and request data
  • Report the activity to the National Center for Missing and Exploited Children (NCMEC) and to law enforcement as required by federal law

6. Rate Limits

Each access tier has a specified request rate. Exceeding your tier's rate limit will result in temporary throttling. Sustained or deliberate abuse of rate limits may result in permanent access revocation.

7. Data Accuracy

Metadata is collected from public sources and automated classifiers. We do not guarantee the accuracy, completeness, or timeliness of any data returned by the API. Tags and descriptions are generated by automated systems and may contain errors. Content filtering is automated and may not capture every instance of prohibited content.

8. Intellectual Property

The metadata, tag structures, and descriptions provided through the API are compiled and produced by Lagoon. The underlying artworks belong to their respective creators. The API provides metadata about publicly available works and does not claim ownership of any artwork.

9. Payment, Billing, and Refunds

Usage tier. Usage-tier accounts maintain a prepaid balance. Each API request deducts from your balance at the rate published on the pricing page at the time of the request. When your balance reaches zero, API access reverts to free-tier rate limits. You may request a refund of your unused balance at any time by contacting [email protected]. Refunds of unused balances are processed within 14 business days to the original payment method.

Pro tier. Pro subscriptions are billed monthly on a recurring basis. By purchasing a Pro subscription, you authorize us to charge your payment method automatically each billing cycle until you cancel. You will be notified of the recurring charge amount and billing frequency before your first payment. You may cancel at any time through your dashboard or by contacting [email protected]. Cancellation takes effect at the end of the current billing period and you retain access until that date. No refunds are issued for partial billing periods.

Enterprise tier. Enterprise accounts are billed on terms specified in the individual agreement.

Refunds. We issue refunds for verified billing errors and for extended service outages (defined as more than 24 consecutive hours of downtime). Refund requests must be submitted within 30 days of the charge in question. No refunds are given for accounts terminated due to violation of these terms. To request a refund, contact [email protected] with your account email and a description of the issue.

Price changes. We may change pricing at any time. Price changes to recurring subscriptions take effect at the start of the next billing cycle. We will notify active subscribers by email at least 14 days before a price increase takes effect.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lagoon, its operators, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the API, your violation of these terms, or your violation of any law or the rights of any third party.

11. Termination

We may suspend or terminate your access at any time for any reason, including but not limited to violation of these terms, suspected illegal activity, or abuse of the service. You may cancel your paid subscription at any time. Cancellation takes effect at the end of the current billing period.

12. Limitation of Liability

The API is provided "as is" without warranty of any kind, express or implied. Lagoon is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of the API, including but not limited to lost profits, data loss, or service interruptions. Total liability is limited to the amount you paid for the current billing period.

13. Age Requirement

You must be at least 18 years old to create an account or use the API. By using the service, you represent that you meet this requirement.

14. Governing Law

These terms are governed by applicable United States federal and state law. Any disputes arising under these terms will be resolved in the state or federal courts of the operator's jurisdiction. You consent to the exclusive jurisdiction of these courts.

15. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting [email protected]. If the dispute is not resolved within 30 days, either party may proceed with legal action in the courts specified in Section 14.

16. Changes

We may update these terms at any time. Changes take effect when posted. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use of the API after changes are posted constitutes acceptance of the updated terms.
